Acceptance of Terms

By adding WishWave to your Discord server or using our website, you agree to these Terms. If you are using WishWave on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Service Description

WishWave provides birthday tooling for Discord communities, including onboarding, a dedicated channel, birthday scheduling based on user-provided timezones, public celebration pages that aggregate wishes and media, and cross-server announcements for servers you share with the bot and choose to advertise to.

Eligibility

You must have a valid Discord account and be at least 13 years old (or the minimum age in your country) to use the Service. Server administrators are responsible for ensuring their communities meet applicable age and consent requirements.

Use of the Service

  • You must comply with Discord’s terms, community guidelines, and applicable laws.
  • Do not interfere with, disrupt, or abuse the Service, attempt unauthorized access, or use automated means except as permitted by our interfaces.
  • Server administrators are responsible for configuring channels, permissions, and moderation rules appropriate for their community.
  • When posting from Discord to a public page, we may request publish permissions via DM; you can allow or deny publishing.

Public Pages & Visibility

Wishes and media posted to celebration pages may be publicly accessible to anyone with the link. Do not post content you do not have permission to share publicly.

Content Rights & License

  • You retain your rights to content you submit.
  • By submitting content, you grant WishWave a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely to operate, provide, and improve the Service (including streaming between Discord and the web, and generating celebration pages).
  • You represent that you have all rights and permissions to submit the content and to grant this license, and that your content does not infringe others’ rights or violate law.
  • We may remove or restrict content that violates these Terms, community guidelines, or law, or to protect users and the Service.

Prohibited Content & Conduct

  • Illegal, harassing, hateful, sexual, doxxing, or infringing content.
  • Malware, phishing, spam, or attempts to bypass security or rate limits.
  • Impersonation or misrepresentation of affiliation without authorization.

Privacy

Our processing of personal data is described in the Privacy Policy. By using the Service, you acknowledge that we will process data as described there. Where required, we will seek consent.

Service Changes & Availability

We may modify, suspend, or discontinue features at any time to improve the Service, address security, or comply with law. We strive for high availability but do not guarantee uninterrupted operation. Beta or experimental features may change or be withdrawn without notice.

Feedback

If you provide feedback or suggestions, you grant us a non-exclusive, worldwide, royalty-free license to use them for any purpose without obligation to you.

Termination

You may remove the bot at any time. We may suspend or terminate access if you breach these Terms, create risk or harm, or for operational/security reasons. Certain sections that by their nature should survive termination will survive, including Content Rights & License, Disclaimers, Limitation of Liability, and General Terms.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the extent permitted by law, WishWave and its affiliates shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, or data, even if advised of the possibility. Our aggregate liability for any claim relating to the Service shall not exceed the amounts you paid to us, if any, for the Service in the 12 months before the claim arose.

General Terms

  • These Terms, together with the Privacy Policy, form the entire agreement between you and us regarding the Service.
  • If any provision is unenforceable, the remainder remains in effect.
  • You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or asset transfer.
  • Nothing herein creates an agency, partnership, or employment relationship.

Changes

We may update these Terms. Continued use after changes become effective constitutes acceptance of the updated Terms.
